Definitions

‘HEI’ means a Higher Education Institution, including Universities; 

‘iQ’ means IQSA Holdco Limited or any of its subsidiaries; 

‘iQ Property’ means a property managed by IQSA Services Limited; 

 ‘Lockdown’ means the period from 5 January 2021 to the earlier of (i) the date upon which students are permitted to return to their accommodation in line with government guidance or (ii) 12 April 2021; 

‘Next Instalment’ means the next rent instalment due following 31 March 2021 pursuant to your Tenancy Agreement; 

‘Rent Discount’ means the crediting of the Rent Discount Amount to your Next Instalment; 

‘Rent Discount Amount’ an amount equal to the rent payable by you to Us pursuant to your Tenancy Agreement for any period in which you are not occupying your Room during Lockdown; 

‘Room’ means your room as defined in your Tenancy Agreement; 

‘Tenancy Agreement’ means your tenancy agreement with iQ for the 2020/21 academic year; and 

 ‘Us’ or ‘We’ means IQSA Services Limited acting as property managers on behalf of iQ. 

Terms of offer 

  1. You are eligible for the Rent-Free Period, and its subsequent extension, if you: 
    •    have a valid Tenancy Agreement for the 2020/21 academic year with iQ;  
    •    pay your rent directly to iQ and not to an HEI or other organisation;  
    •    have previously checked into your room in the 2020/21 academic year,  
    •    have not returned to your room on, or since, 4 January 2021;  
    •    have paid up to date all rent instalments and any other charges which are due under your Tenancy Agreement with iQ; and  
    •    successfully applied for the residential rent offer (rent free period) by the deadline of 27 January 2021, unless explicitly instructed otherwise. 

 

  1. To make a Rent Discount request, you must use our online iQ Customer Rent Discount form via the ‘Lockdown discount module’ within the iQ portal or iQ resident app by 27 January 2021. Rent Discount requests cannot be accepted by any other means of notification. 

 

  1. Once you have submitted a Rent Discount request, We will inform you whether you have satisfied the criteria set out in clause 1 above within 14 days of receipt of your Rent Discount request.  If we approve your Rent Discount subject to clause 4 below, Your Rent Discount will be credited to your Next Instalment and We will confirm the final Rent Discount Amount due to you when your account is credited. 

 

  1.  In order to ensure your Rent Discount is applied to your Next Instalment, you must ensure that there are no outstanding amounts due on your account with Us as at 31 March 2021.  If the above condition is not satisfied, your right to receive a Rent Discount is automatically rescinded. 

 

  1. You agree that upon Us accepting a request for a Rent Discount, your fob or key access to your Room and iQ Property may be deactivated. This will be reactivated on your return to your iQ Property at reception.  

 

  1. For the avoidance of doubt, if you need to occupy your Room before the end of Lockdown, your obligation to pay rent pursuant to your Tenancy Agreement will recommence on the date you return to your Room. 

 

  1. For the avoidance of doubt, you will not be eligible for a Rent Discount if you do not pay your rent direct to iQ.  If you pay your rent to your HEI or another organisation, you will need to contact them to discuss your circumstances.  

 

  1. If you paid your annual rent in full pursuant to your Tenancy Agreement, we will process your refund the Rent Discount Amount on or before 31 March 2021 and make payment once We are in receipt of your UK bank details. 

 

  1. This offer does not amend or change the terms of Our Cancellation Policy which is set out in the Booking Terms and Conditions. If you wish to cancel your tenancy, Our Cancellation Policy will apply. 

 

  1. The decision of iQ regarding any aspect of this offer and these terms and conditions is final. We reserve the right to withdraw or change this offer and these terms and conditions at any time. 

 

  1. These terms and conditions (including any claims or disputes relating thereto) shall be governed by and construed in accordance with the laws of England and Wales.
